Terms of Service

1. Purpose

These terms govern access to and use of the Pinivy service, published by Pinivy SAS, which generates Pinterest-optimized visuals (“pins”) from a URL, text or image.

Creating an account or using the service implies full acceptance of these terms.

2. Account

Sign-up is by email/password or via a third-party provider (Google, Pinterest). You are responsible for keeping your credentials confidential and for all activity on your account.

The service is reserved for adults or those with the authorization of their legal guardian.

3. Free trial and subscriptions

The free trial offers 3 pins, no credit card required. Paid plans (Micro, Starter, Pro, Business) grant a monthly pin quota, specified on the Pricing page at the time of subscription.

Subscriptions are monthly or annual and renew automatically until cancellation. Prices are shown in euros, plus any applicable taxes.

4. Payment

Payments are processed by Stripe. Pinivy stores no card data. The pin quota is decremented on each successful generation; failed generations are not counted.

5. Cancellation and withdrawal

You may cancel at any time from your billing area; the subscription remains active until the end of the current period, with no further renewal.

Under applicable law, the right of withdrawal does not apply to digital content whose delivery has started with your consent; using the service constitutes such consent.

6. Ownership of content

You retain ownership of the URLs, texts and images you submit. You warrant that you hold the necessary rights to this content and agree not to submit unlawful, infringing or rights-violating content.

Generated pins are licensed to you for commercial or personal use. Pinivy claims no exploitation rights over your final pins.

7. Acceptable use

• Do not circumvent quotas or the technical mechanisms of the service.
• Do not generate hateful, sexual, deceptive or illegal content.
• Do not resell or automate access outside the provided API keys and MCP integration.

8. Availability and AI

Pinivy relies on third-party artificial intelligence models. The service is provided “as is”: the quality, spelling accuracy or compliance of generated pins is not guaranteed, and some requests may be refused by providers' moderation filters.

Pinivy may temporarily suspend the service for maintenance or improvements.

9. Liability

Pinivy's liability shall not exceed the amounts paid over the last twelve months. Pinivy is not liable for indirect damages, nor for your use of the generated pins (publishing, compliance with Pinterest rules, etc.).

10. Governing law

These terms are governed by French law. Failing an amicable resolution, any dispute falls under the jurisdiction of the French courts.
